Terms of Use

These Terms of Use ("Terms") govern your access to and use of the FotoFont mobile application ("the app") and related services. By downloading or using FotoFont, you agree to these Terms.

1. Use of the App

FotoFont allows you to create TrueType font files from photographs of your handwriting. Some functionality, including font generation and export, relies on hosted services we operate or make available. You may use the app for personal and commercial purposes, subject to these Terms.

You retain all rights to your handwriting, photographs, and the font files you create using FotoFont. We claim no ownership over your content. Subject to these Terms, font files you have already exported or downloaded are yours to use, share, and distribute as you see fit.

Our Content

The FotoFont app, including its design, code, branding, and documentation, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute the app itself.

3. Original Content Requirement

You may only submit images of your own original handwriting. You may not use FotoFont to reproduce, trace, scan, or convert existing typefaces, fonts, or lettering designed by others. The ownership rights granted to you over your generated fonts apply only to fonts created from your original handwriting. You are solely responsible for ensuring that the content you submit does not infringe on the intellectual property rights of any third party. FotoFont assumes no liability for claims arising from the submission of content you do not have the right to use.

4. Purchases

FotoFont offers a free tier with base character sets (letters) and optional one-time in-app purchases that unlock additional features, character groups, or export entitlements. These purchases are not subscriptions and do not guarantee any minimum period of access to any hosted service, feature, or functionality.

In-App Purchases

All purchases are one-time transactions. There is no recurring billing or automatic renewal. All payment processing is handled by Apple through the App Store and is subject to Apple's terms.

The "Unlimited" purchase means export access without a stated numeric cap while the relevant hosted service and feature remain available in FotoFont. It does not mean lifetime access, perpetual service availability, or a promise that hosted font generation or export will continue for any particular period.

Refunds

Except where required by applicable law, all purchases are final and non-refundable. Any refund, credit, or other remedy not required by law is optional and may be granted or denied in FotoFont's sole discretion. Because purchases are processed through Apple, any approved refund or credit may also be subject to Apple's platform rules and procedures.

Price Changes

We reserve the right to change pricing for in-app purchases. Price changes will not affect purchases you have already made.

5. Hosted Services; Changes, Suspension, and Discontinuation

FotoFont relies on hosted backend services for certain features, including font generation and export. We may, at any time and for any reason, suspend, restrict, modify, deprecate, or discontinue the app, the hosted service, or any feature, function, or part of the service, temporarily or permanently.

When practical, we may provide notice of a material change, suspension, deprecation, or discontinuation through the website, within the app, or through other public-facing communications. Because FotoFont does not require user accounts and we may not have your email address or other direct contact information, direct notice may not be possible and is not guaranteed.

If the hosted service or any related feature is suspended, deprecated, or discontinued, font files you already exported or downloaded before that date remain yours to use under these Terms. However, any unused export entitlements, unused packs, unused credits, pending processing, and any future ability to generate, rebuild, export, or otherwise obtain fonts through the hosted service may become unavailable, be forfeited, or be permanently lost, without liability to FotoFont except to the extent required by law.

To the maximum extent permitted by law, FotoFont and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of profits, loss of access to hosted features, or damages resulting from font files that do not render as expected.

8. Indemnification

You agree to indemnify and hold harmless FotoFont and its developers from any claims, damages, or expenses arising from your use of the app, including but not limited to claims related to fonts you create or content you submit.

9. Children

FotoFont is rated 4+ and is suitable for general audiences. We do not knowingly collect personal information from children under 13. The app does not require account creation or collect user data beyond what is described in our Privacy Policy.

10. Suspension and Termination

We reserve the right to suspend or terminate your access to the app if you violate these Terms. We may also suspend, restrict, or discontinue all or part of the app or service as described in Section 5. You may stop using the app at any time by deleting it from your device.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the app after changes constitutes acceptance of the updated Terms.
